Sanitation Worker Gets $ 5,250,000 After Forklift Runs Over Ankle

In 2008, 37 year old Sanitation Worker Andrew Anderson, was working at a New York City sanitation garage helping install a snow plow when his co-worker accidentally ran over his ankle with a forklift. He sustained a severe ankle fracture which required two surgeries. He also developed post-operative complications including RSD (reflex sympathetic dystrophy) and foot drop which requires the use of a brace. As a result, he never returned to work. He was forced to retire early and was awarded a 3/4 accident disability pension with the help of his attorney Todd J. Strier.

As a result of the accident, Anderson hired Todd J. Strier from the law firm of Kelner & Kelner to represent him and his wife, also a plaintiff in the case, for claims of personal injury, lost earnings and loss of consortium. An action was commenced in Supreme Court, New York County (index number 105600/08) against the City of New York.

Mr. Strier and his firm successfully moved for and received summary judgment on the issue of liability. The liability decision was not appealed by the City of New York lawyers and the case went to trial in June 2011 for damages only. The trial was settled, at the last minute, in the amount of $ 5,250,000 immediately before jury deliberations.

"In our opinion, it was an excellent and much deserved result given the facts and circumstances. There was always the possibility that a jury would have given the Anderson's less, or an appellate court may have reduced the verdict below the offer," said Todd J. Strier.
